# US tax for Americans in Sri Lanka

There is a US–Sri Lanka income tax treaty and no totalization agreement. Personal income tax rates were increased materially during the post-2022 fiscal reforms and now reach 36%, which changes the credit-against-exclusion comparison — and leaves 15.3% self-employment tax standing for consultants whatever that comparison concludes.

## The rates moved, and old comparisons went with them

Sri Lankan personal income tax was increased materially during the fiscal reforms that followed 2022, with rates reaching 36%. Any exclusion-against-credit comparison built on pre-reform assumptions is answering a question that no longer exists — higher Sri Lankan tax means more creditable tax, which generally moves the answer toward the credit.

Where a rate or a relief cannot be verified for the particular tax year, this guide says so rather than carrying a figure forward. Bring your Sri Lankan assessment and the comparison is done on the real numbers.

## A treaty that does not reach social security

The treaty relieves double income tax and Sri Lankan tax is creditable on Form 1116. It does not reach social security, and there is no totalization agreement — so consultants and contractors pay 15.3% self-employment tax in full on net earnings, whatever the income tax side does.

## Foreign currency accounts are reportable regardless

Foreign currency accounts held by non-residents are common in Sri Lanka, and they count towards both the FBAR $10,000 aggregate and Form 8938. The local tax treatment of the interest has no bearing on either obligation — reporting follows the account, not the tax.

## What a devalued currency does to a US return

Income and tax are translated into dollars for the US return, and a sharp currency movement changes both figures without anything changing in rupee terms. That affects the size of the credit and the amount of income reported, and it is worth doing deliberately with the right rates rather than approximating.

## A worked example, tax year 2025

A single American consulting from Colombo, $80,000 of net self-employment earnings, with Sri Lankan income tax of $20,000 for the year.

| Net self-employment earnings | $80,000 |
| --- | --- |
| Sri Lankan income tax paid | $20,000 |
| US income tax after the exclusion or the credit | $0 |
| Self-employment base, 92.35% of net earnings | $73,880 |
| Self-employment tax at 15.3% | $11,304 |
| Relief available from the treaty | None for this charge |

Either route clears the income tax at this level — the exclusion covers $80,000 outright, and Sri Lankan tax would credit against it anyway. The $11,304 of self-employment tax is what remains, because the treaty addresses income tax and only a totalization agreement could reach this. ## Questions Americans in Sri Lanka ask

### Have Sri Lankan tax rates changed?

Yes, materially. Personal income tax was increased during the post-2022 fiscal reforms and now reaches 36%, so comparisons built on older rate assumptions are out of date — more Sri Lankan tax generally moves the answer toward the credit.

### Do I report my Sri Lankan foreign currency account?

If your foreign accounts together touched $10,000 at any point in the year, yes — on the FBAR, and on Form 8938 if its thresholds are met. The local tax treatment of the interest does not change either obligation.

### Why do I still pay self-employment tax with a treaty in place?

Because a treaty addresses income tax and only a totalization agreement addresses social security. There is no US–Sri Lanka totalization agreement, so 15.3% SECA applies to net self-employment earnings in full.

### How does a currency movement affect my US return?

Income and foreign tax are both translated into dollars, so a sharp move changes the reported income and the credit without anything changing in rupees. It is worth translating deliberately with the correct rates rather than approximating.

### I have not filed for several years while in Sri Lanka. What now?

If the failure was non-willful — which describes most people in this position — the Streamlined Foreign Offshore Procedures waive the failure-to-file, failure-to-pay and FBAR penalties: three years of returns, six years of FBARs, and Form 14653.
